Measures 8-13/16" X 10-31/32", 64 pp plus covers, b w illustrations by RICK SCHREITER, Volume 1, Number 5 (September-October 1964), published by Fact Magazine (NY). FACT MAGAZINE was another short-lived attempt by publisher RALPH GINSBURG to produce a slick-looking newsstand magazine, which could be entertaining while controversial, for an audience of young, intellectual readers who would not be upset by raunchy language or subject matter; but, like Ginzburg's previous attempt with the magazine EROS (for which he was sentenced to prison for violating obscenity laws), FACT MAGAZINE was also doomed to die an early death, after US Senator BARRY GOLDWATER sued Ginsburg for libel in 1966, after this particular issue of FACT MAGAZINE suggested that Goldwater was mentally unstable (as attested to by 1,189 psychiatrists, whose opinions consist of this entire issue). BARRY GOLDWATER (who was the Republican candidate for U. S. President concurrent with this 1964 issue) won his case against RALPH GINZBURG, and the court awarded Goldwater $75,000 in damages. On the other hand, the court also awarded "compensatory" damages to Ginzburg -- of $1.00.
