Terms and Conditions
The following terms and conditions (Terms and Conditions) applies to all visitors and shall include without limitation, persons and representatives of legal entities, whether such representatives are persons or digital engines of any kind, including without limitation ones that crawl, spider, ingest, index, scrape, copy, store, display or transmit digital content (You), and explicitly prohibits Your use of any content of Midway Module’s websites, including without limitation text, data, information, photos, graphics, audio and video material created, gathered, generated by Midway Module and displayed on any website or digital service through which You accessed these ‘Terms and Conditions’. When You access this website or digital service You agree that these ‘Terms and Conditions’ govern Your use of this website to access our services and constitute a legally binding agreement between You and Midway Module whose principle place of business is 8482 Fort Smallwood Road, B 102, Pasadena, Maryland 21122.

Prerequisites
Prepayment is required before we service your electronic circuit board (module). We must receive your module intact without damage from previous repairs, shipping, intentional or unintentional tinkering, corrosion, insect infestation, and we refuse to pay shipping and handling to return a module received under these preceding abnormal conditions if we deem it non repairable or it tests good. However, solely at our discretion we may decide to repair your module even if you have attempted a repair on it or we receive it with abnormal damage if the damage is manageable. Buyer is responsible for initial shipping cost of sending their module to us. Buyer may incur a payment processing fee for a cancelled order.

Technical Support
If during ‘The Warranty Period’, a customer wishes to use our technical support, the customer must first provide notice using the email: [email protected]

Midway Module’s technical support is limited to ‘The Warranty Period’, and exclusively provided by email. If Midway Module should agree to allow testing of a module other than the serviced module, which must be sent to Midway Module with our prior consent, the shipping, handling, and testing costs shall remain the responsibility of the customer.

In no event shall Midway Module be liable for physical injury to customer or participants, consequential damages, incidental damages, equipment damage, lost profits, or lost revenue as a result of using our technical support. Safety is the sole responsibility of the customer and participants.

Order Acceptance
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to provide service. Midway Module reserves the right at any time after receipt of your order to deny service solely at our discretion.

Supply Chain Interruptions
We will complete and ship your equipment as parts become available. Usually, modules are completed and shipped within 1-4 business days after we receive them from you. However, there may be times when parts are depleted and arrive late due to supply chain delays, which will delay the shipment of your module.

Copyright and Trademark Notice
Unless otherwise specified, all materials appearing on this site; including text, site design, logos, graphics, icons, images, proprietary processes as well as the selection, assembly and arrangement thereof, are the sole property of Midway Module.

Sales Taxes
There is no sales tax levied for our servicing of electronics products within the State of Maryland, therefore, we do not charge you sales tax on our service nor do we collect sales tax for any entity. All parts we install in the servicing of your electronic module are included with our service at no extra charge to you. We pay all sales taxes and import tariffs levied on parts we purchase to service your electronic module. If you purchase our service from a third party website you may have to pay sales tax for our service to that third party.

Proprietary Rights
All rights, title and interest in and to our business name Midway Module and our ‘Better Than New 5 Step Process’ shall remain the property of Midway Module and/or its licensors, including without limitation any intellectual property rights, which subsist in our ‘Better Than New 5 Step Process’. You agree to comply with any instructions set out in any robots.txt files associated with Midway Module, including any requirements with regard to your access to our websites.

General
You agree to indemnify, hold harmless and defend Midway Module, its directors, officers, employees, subsidiaries, licensors and content providers, in respect of all damages, costs and expenses, including reasonable legal fees and litigation expenses, arising out of or as a result of any breach of these ‘Terms and Conditions’ or otherwise in connection with Your use of PayPal and any other financial institutions to pay for our services. If any provision in these ‘Terms and Conditions’ is declared to be invalid or unenforceable in any respect by a court of law having jurisdiction to decide, then the invalid or unenforceable provision will be removed from the ‘Terms and Conditions’ without affecting the rest of the terms, which will continue to be valid and enforceable, and a valid and enforceable provision that approximates the intent of the invalid or enforceable provision as closely as possible shall be substituted for the invalid or unenforceable provision. Notwithstanding any choice of law, venue or jurisdiction provisions in association with the website or digital service through which You accessed these ‘Terms and Conditions’ these ‘Terms and Conditions’ shall be governed by, construed and take effect in accordance with the laws of the State of Maryland and jurisdiction for any claims arising under these ‘Terms and Conditions’ shall lie exclusively with the state and federal courts situated in Maryland, and all such claims shall be adjudicated under Maryland law, without reference to its conflict of law principles.
